The said Jim Scruggs and his wife, Fannie Scruggs are now deceased. The said Clyde Scruggs and his wife, Lillie Mae Scruggs, are now both deceased leaving the property to their children, Billy Dean Scruggs and Judy Lynn Holland. The address of the Subject Property as shown on the tax records for Trousdale County, Tennessee, is 2065 Lick Creek Road, Hartsville, Tennessee, 37074 as shown on Trust Deed and 65 and 115 Scruggs Lane as shown on record of the Property Assessor. (Map 21, Parcel 30.03) It will be the responsibility of the successful bidder to obtain possession of the property at his expense. The successful bidder shall be responsible for any damage, vandalism, theft, destruction, etc., to the property. This sale is subject to valid filed or unfiled mechanic's and materialmen's liens. No representations are made as to the validity or enforceability of any memorandum of mechanic's liens or any suit to enforce the same. We have no way of determining the correct address(es) for the subject property and can make no certification as this matter. 4. This property may be subject to fees, dues and assessments of a Homeowners?' Association. The actual existence of an association and the imposition of fees, dues and assessments are not typically of record in the Register of Deeds Office and you should ascertain whether a Homeowners' Association has actually been formed and whether there are any unpaid fees, dues or assessments. This property is subject to the right of way of Lick Creek, which flows through the subject property and rights of upper and lower riparian owners in and to the use of and the continued uninterruped flow of Lick Creek. 6.
