Acting pursuant to the Decree of the Chancery Court of Wilson County, Tennessee, under the date of June 21, 2022, the following properties located in the 4th Civil District of Wilson County, Tennessee and more commonly known as 437 Burton Road, Mt. Juliet, Tennessee, and 450 Burton Road, Mt. Juliet, Tennessee, will be offered for sale on the premises at public auction on Saturday, August 20, 2022,

beginning at 10:00 a.m. Said real properties are further described as follows:

437 Burton Road, Mt. Juliet, Tennessee (Map: 33 / Parcel: 12.00)

A lot located on the north side of a proposed and adjoining new road; and Beginning on a “hub” set by the Government Surveyors north of the center line of said proposed new road, and running north 74¼◦ east 199.8 feet to a point in Adams’ west line; thence south 87½◦ west 209.7 feet to the beginning, and containing 4,802.485 feet or .110 acre, more or less, according to the survey of R. B. Butler, Surveyor, dated March 27, 1954.

Being the same property conveyed to Hugh Donald Crabtree and Brenda J. Crabtree by deed from J. K. Winters and wife, Hilda W. Winters, dated September 2, 1976, of record in Deed Book 299, page 470, Register’s Office for Wilson County, Tennessee.

Land lying and being in the 4th Civil District of Wilson County, Tennessee, and more particularly described as follows:

Said property is composed of two small pieces or parcels of land, described to wit:

Tract No.1: A tract of land, lying on the South side of and adjoining a proposed New Road, and beginning at a point in the west boundary line of the property belonging to the Estate of A. A. Adams, Jr., the same being 75 feet south of the center line of said proposed New Road, the same being the estimated location of the south boundary line of the Cut to be made in connection with said road, and running thence with Adams’ line, south 24° 16 minutes east 131.7 feet to a point in Adams’ line; thence west 125.9° feet to a cross-cut on a rock; thence north 24° 16 minutes West 131.7 feet to a point 75 feet south of the center line of said Road, being the estimated south boundary line of said Cut to be made in connection with said Road; thence east with the margin of the estimated Cut, 125.9 feet to the beginning; and containing 15,120.59 square feet or 0.347 acres, more or less.

Tract No. 2: A certain strip or parcel of land 15 feet wide as measured at a right angle to its long side; on the south side of a County Road; and BEGINNING on the south margin of the said County Road at a distance of thirty (30) feet from the Center line in the west line of the Adams’ Estate Lands running thence south 24° 16 minutes east 16.5 feet to Burton’s east corner; thence with Burton’s north line, west 125.9 feet to his northwest corner; thence north 24° 16 minutes west 16.5 feet to the south line of said County Road; thence with the said South line, East 125.9 feet, to the beginning corner.

Being the same property conveyed to Hugh Donald Crabtree by deed from E. W. McIntosh dated July 16, 1992, and of record in Deed Book 438, Page 728, Register’s Office for Wilson County, Tennessee. Reference is further made to Deed Book 438, Page 729, Register’s Office for Wilson County, Tennessee, in which said instrument created a tenancy by the entirety from H. D. Crabtree, a/k/a Hugh Donald Crabtree to Brenda J. Crabtree dated March 10, 1994.

Hugh Donald Crabtree and Brenda J. Crabtree divorced April 1, 2005, as evidenced in Wilson County Circuit Court Case No.: 02-4716-DV. Brenda J. Crabtree died testate on January 4, 2006, owning a one-half interest in the above-referenced properties. By Quitclaim Deed dated April 28, 2008, Terry M. Rymar, Executrix of the Estate of Brenda J. Crabtree, conveyed Brenda J. Crabtree’s one-half ownership interest in equal shares to Donald R. Crabtree, Ronald C. Crabtree, Leona L. Colton, Jennie L. Wright, Venetia J. Glover and Terry M. Rymar.

Hugh Donald Crabtree quitclaimed his one-half interest in and to the above-described tracts or parcels of land to Ronald C. Crabtree, by deed dated October 21, 2011, of record in Deed Book 1462, Page 1228, Register’s Office for Wilson County, Tennessee.

TERMS OF SALE: The Special Commissioner & Receiver will sell all right, title and interest in and to the above-described real property to the highest, last and best bidder, with the assistance of Jim Agee, Auctioneer, and Agee & Johnson Realty and Auction. The real property is being sold “As Is”. Terms of 10% down on the date of sale, with the balance due upon closing. Real property taxes for the year 2022 shall be prorated between the Buyer and Seller. Possession will be given with deed after the date of confirmation by the Chancery Court. Sale is being made subject to such encumbrances and exceptions as may be determined to be against the property. Announcements made on the sale date take precedence.
